COURTROOM UPDATE - 6/26/08: Entwistle to serve time at Shirley prison
posted at 4:44 p.m.: The Department of Correction has confirmed that Neil Entwistle will serve his sentence at the Souza-Baranowski Maximum Level Security Center in Shirley.
posted at 11:30 a.m.: Neil Entwistle has "nothing to look forward to," as he heads to prison for the murders of his wife and child, his lawyer Elliot Weinstein said today outside of court.
Entwistle was sentenced to life in prison without the chance of parole today after his conviction for two counts of first-degree murder.
"It's a reality he will have to look forward to until we are successful with his appeal," Weinstein said.
He said the appeal could take years, but he is confident Entwistle will once again be a free man.
Weinstein also railed against media comments that he and co-defense lawyer Stephanie Page did not make a defense.
He said, "Everytime we asked a question, we presented a defense."
Weinstein also said it is unfair that the public, and most likely the jury, expects a defendant to defend themselves.
"We have the burden of proof," he said. "That's on the prosecution."
Page said the prosecution did not fully investigate the gunshot residue evidence. Gunshot residue was found on Rachel's hands, and the defense claims she murdered her daughter Lillian Rose and then killed herself.
"That evidence was never fully investigated," Page said. "If it had been, we wouldn't be sitting here today."
posted at 10:16 a.m.: Judge Diane Kottmyer has sentenced Neil Entwistle to life in prison for the murder of his wife and baby, and has imposed a condition that he not profit from the sale of his story in any way.
The judge said it would only be "symbolic" to sentence him to two consecutive life sentences - one for each murder - and so instead the two will run concurrently. The judge made a point to say that in this state, this sentence has no chance for parole and Entwistle - if his appeal is unsuccessful - will actually remain in jail for life, only except if the governor issues a pardon.
Regarding the two possession charges - of a firearm and of ammunition - he will be put on probation for 10 years, to run concurrent with his life sentence, with the condition that he not profit from the sale of his story.
Kottmyer said he will serve his time at Massachusetts Correctional Institution at Cedar Junction in Walpole.
posted at 9:02 a.m.: Neil Entwistle and his lawyers are ready to hear whatever Rachel Entwistle's family has to say to them this morning.
Entwistle, 29, was convicted yesterday of two counts of first-degree murder for the Jan. 20, 2006, deaths of his wife Rachel, 27, and daughter Lillian Rose, 9 months.
Today, at 10 a.m., victim impact statements and sentencing are scheduled.
"We know we will hear the anguish, the grief, the heartache of the Matterazzo family and the Souza family," said defense attorney Elliot Weinstein. "We understand that. We will have to listen to it and endure that."
Weinstein also reiterated that Neil Entwistle has a strong case for appeal because the Hopkinton Police twice entered his 6 Cubs Path home without permission or a warrant.
"It is absolutley clear in the constitution that we should all know and that we all love, the police are now allowed to enter the house without a warrant," he said.
